<h1>Terms of Service for Key Mapper Gaming Pro</h1>

<em>Effective immediately</em></p>

<p>Please read these Terms of Service ("Terms") carefully before using the Key Mapper Gaming Pro application (the "Application" or "App"). These Terms constitute a legally binding agreement between you and sds100 ("Service Provider," "we," "us," or "our") that applies once you use the Application, governing your access to and use of it.</p>

<p>By using Key Mapper Gaming Pro, you agree to be bound by these Terms. If you do not agree, do not use the Application.</p>

<h2>1. Definitions</h2>

<ul>
<li><strong>"Service Provider," "we," "us," or "our"</strong> refers to sds100, the developer and operator of the Application.</li>
<li><strong>"Application" or "App"</strong> refers to Key Mapper Gaming Pro, including all updates, patches, add-ons, and related services.</li>
<li><strong>"User," "you," or "your"</strong> refers to any individual who accesses or uses the Application.</li>
<li><strong>"Content"</strong> refers to all text, graphics, images, software, key-mapping profiles, configuration data, and other materials made available through the Application.</li>
<li><strong>"Services"</strong> refers to all features, functionality, and services provided through or in connection with the Application, including key/button remapping, control overlays, macros, and related tools.</li>
</ul>

<h2>2. Acceptance of Terms</h2>

<p>By using Key Mapper Gaming Pro, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you and sds100. You may download and install the Application without agreeing to these Terms, so that you can review them first; however, you must agree to these Terms before using the Application.</p>

<p>If you do not agree to any part of these Terms, you must immediately discontinue use of the Application and uninstall it from all of your devices. Your continued use of the Application following any modification to these Terms constitutes your acceptance of the revised Terms.</p>

<h2>3. Eligibility</h2>

<ul>
<li>You must be at least 16 years of age. The Application is not directed at children under 16, and we do not knowingly collect personal information from children under 16.</li>
<li>If you are between 16 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Application with the consent and supervision of a parent or legal guardian, who must review and agree to these Terms on your behalf.</li>
<li>You must have the legal capacity to enter into a binding agreement in your jurisdiction of residence.</li>
</ul>

<h2>4. App Usage and Requirements</h2>

<p>Key Mapper Gaming Pro remaps keyboard, mouse, and/or controller inputs for use with games and other applications. Depending on platform and feature set, the Application may require:</p>

<ul>
<li>Accessibility permissions, input-capture permissions, or overlay/draw-over-other-apps permissions</li>
<li>A supported operating system version and compatible input hardware (keyboard, mouse, or controller)</li>
<li>Background running permissions or elevated privileges on certain devices to intercept and remap inputs</li>
</ul>

<p>The Service Provider does not guarantee compatibility with every device, operating system version, game, or anti-cheat system. Some games or platforms may prohibit or restrict input-remapping software under their own terms of service; <strong>it is your sole responsibility to confirm that using Key Mapper Gaming Pro with a given game or platform does not violate that game's or platform's rules before use.</strong> The Service Provider is not responsible for any in-game penalty, suspension, or ban resulting from your use of the Application with third-party software.</p>

<p><strong>General:</strong></p>

<ul>
<li>Refunds are governed by the Google Play refund policy; the Service Provider does not independently process refunds except where required by law</li>
<li>Prices are subject to change; changes will not affect an active billing period or a completed Lifetime Purchase, but may apply to future renewals or new purchases</li>
</ul>

<p>Free trials, if offered, automatically convert to a paid Subscription at the end of the trial unless cancelled beforehand, and you may not receive a separate reminder before conversion.</p>

<h2>5. User License and Intellectual Property</h2>

<h3>License Grant</h3>
<p>Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Application on a compatible device that you own or control, strictly for your personal, non-commercial use.</p>

<h3>Intellectual Property</h3>
<p>The Application, including all Content, features, functionality, design, source code, trademarks, and logos, is and remains the exclusive property of sds100 and its licensors. These Terms grant you no ownership interest in the Application beyond the limited license above.</p>

<h3>Prohibited Actions</h3>
<p>You may not:</p>

<ul>
<li>Copy, modify, adapt, or create derivative works based on the Application</li>
<li>Reverse engineer, decompile, or disassemble the Application, or attempt to extract its source code</li>
<li>Sell, resell, rent, lease, distribute, sublicense, or commercially exploit the Application</li>
<li>Use the Application for any unlawful, unauthorized, or fraudulent purpose, including to cheat, gain an unfair advantage, or violate the terms of any third-party game or platform</li>
<li>Remove or alter any copyright, trademark, or proprietary notices in the Application</li>
<li>Attempt to bypass, disable, or circumvent any security or technical protection measures of the Application</li>
</ul>

<h2>6. User Conduct</h2>

<p>You agree not to:</p>

<ul>
<li>Use the Application in a way that could disable, overburden, damage, or impair it, or interfere with others' use of it</li>
<li>Use bots, scrapers, or automated scripts to access the Application without express written permission</li>
<li>Attempt unauthorized access to any accounts, systems, or networks connected to the Application</li>
<li>Transmit viruses, malware, or other harmful code through the Application</li>
<li>Use the Application to infringe the intellectual property, privacy, or other legal rights of any third party</li>
<li>Use the Application to cheat, gain an unfair competitive advantage, or otherwise circumvent, defeat, or interfere with any third-party game's anti-cheat systems, terms of service, or fair-play rules, including in online or multiplayer games</li>
<li>Engage in conduct that could bring the Service Provider, the Application, or its users into disrepute</li>
</ul>

<p>Key Mapper Gaming Pro is a general-purpose input-remapping tool intended for accessibility, comfort, and convenience. It is not designed or intended to be used for cheating in online or multiplayer games. You are solely responsible for how you use the Application, and for ensuring your use complies with the terms, rules, and anti-cheat policies of any game or platform you use it with. The Service Provider does not condone, encourage, or endorse using the Application to cheat, and accepts no responsibility or liability for any penalty, suspension, ban, loss of progress, or other consequence you incur as a result of using the Application to cheat or otherwise misuse it in online games.</p>

<h2>7. Privacy and Data</h2>

<p>Your privacy is important to us. Our collection, use, storage, and disclosure of your personal information is governed by our Privacy Policy, incorporated into these Terms by reference. By using the Application, you consent to the data practices described there.</p>

<h3>Third-Party Services</h3>
<p>The Application may integrate with third-party services to deliver its features, which may include, for example:</p>

<ul>
<li>Distribution and licensing services (Google Play)</li>
<li>Analytics and crash-reporting services (Sentry)</li>
<li>Subscription and purchase management (RevenueCat)</li>
</ul>

<p>Each third-party service operates under its own terms and privacy policy. The Service Provider is not responsible for the privacy practices or content of any third-party service.</p>

<h2>8. Disclaimers</h2>

<p>THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.</p>

<p>Without limitation, the Service Provider does not warrant that:</p>

<ul>
<li>The Application will meet your requirements or expectations</li>
<li>The Application will be uninterrupted, timely, secure, or error-free</li>
<li>The Application will be free of bugs or vulnerabilities</li>
<li>The Application will be compatible with your specific device, game, or hardware configuration</li>
<li>Remapped inputs will register correctly in every game or under every circumstance</li>
<li>Using the Application will not result in penalties, suspensions, or bans under any third-party game's or platform's terms</li>
</ul>

<p>You use the Application at your own risk. Some jurisdictions do not allow exclusion of certain warranties, so some exclusions above may not apply to you; in such cases, warranties are limited to the minimum scope permitted by law.</p>

<h2>9. Limitation of Liability</h2>

<p>TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SDS100, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:</p>

<ul>
<li>Loss of profits, revenue, data, or goodwill</li>
<li>Loss of or damage to device functionality</li>
<li>Any in-game penalty, account suspension, or ban imposed by a third-party game or platform</li>
<li>Inability to access or use the Application</li>
<li>Unauthorized access to, or loss of, your data or account</li>
<li>Any conduct of a third party in connection with the Application</li>
</ul>

<p>IN NO EVENT SHALL THE SERVICE PROVIDER'S TOTAL AGGREGATE LIABILITY ARISING FROM THESE TERMS OR YOUR USE OF THE APPLICATION EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE SERVICE PROVIDER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) EUR 10.</p>

<p>Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so the above may not apply to you.</p>

<h2>10. Indemnification</h2>

<p>You agree to indemnify, defend, and hold harmless sds100 and its directors, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:</p>

<ul>
<li>Your use or misuse of the Application</li>
<li>Your violation of these Terms or any applicable law or third-party right</li>
<li>Your negligent, fraudulent, or willful misconduct</li>
<li>Any dispute between you and a third party (including a game publisher or platform) arising from your use of the Application</li>
</ul>

<h2>11. Termination</h2>

<p>The Service Provider may suspend, restrict, or terminate your access to the Application, in its sole discretion and without prior notice, if:</p>

<ul>
<li>You breach any provision of these Terms</li>
<li>Unauthorized or fraudulent use of your account is suspected</li>
<li>Your continued access poses a security risk to the Application or other users</li>
<li>Termination is required by law or a valid legal request</li>
</ul>

<p>Upon termination, your license to use the Application immediately ends and you must uninstall it from all devices. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.</p>

<h2>12. Dispute Resolution and Governing Law</h2>

<h3>Governing Law</h3>
<p>These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Nothing in this section deprives you of any mandatory consumer protection you are entitled to under the law of your country of residence, where applicable.</p>

<h3>Informal Resolution</h3>
<p>Before initiating formal proceedings, you agree to first contact us at legal@keymapper.app and attempt to resolve the dispute informally for at least thirty (30) days.</p>

<h3>Jurisdiction</h3>
<p>Subject to the informal resolution process above, and to any mandatory consumer protections available in your country of residence, the competent courts of the Netherlands shall have exclusive jurisdiction over any dispute arising from or relating to these Terms.</p>

<h2>13. Changes to Terms</h2>

<p>The Service Provider may update these Terms at any time. Material changes will be notified via an in-app notice, or an updated "Last Updated" date. Continued use of the Application after changes take effect constitutes acceptance of the revised Terms. If you disagree, you must stop using the Application and uninstall it.</p>

<h2>14. General Provisions</h2>

<p><strong>Severability</strong> — If any provision is found invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision will be modified to the minimum extent necessary to be enforceable.</p>

<p><strong>Waiver</strong> — Failure to enforce any right or provision is not a waiver of that right. Waivers are effective only if made in writing by an authorized representative of the Service Provider.</p>

<p><strong>Entire Agreement</strong> — These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Service Provider regarding the Application, superseding all prior understandings.</p>

<p><strong>Assignment</strong> — You may not assign your rights or obligations under these Terms without our prior written consent. The Service Provider may freely assign its rights and obligations.</p>

<p><strong>Force Majeure</strong> — The Service Provider is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, war, internet or infrastructure failures, or pandemics.</p>

<p><strong>Feedback</strong> — Any feedback or suggestions you provide regarding the Application are non-confidential and non-proprietary, and the Service Provider may use them for any purpose without compensation or attribution.</p>

<h2>15. Google Play Compliance</h2>

<p>The Application is distributed through Google Play and complies with the applicable Google Play developer distribution agreement and program policies. You acknowledge that Google LLC is a third-party beneficiary of these Terms with the right to enforce them. In the event of any conflict between these Terms and Google Play's terms, Google Play's terms prevail to the extent of the conflict.</p>
